  • How long does and expungement take?
    • Expungement of a misdemeanor typically takes 4-6 weeks.
  • Am I eligible for expungement?
    • Certain offenses cannot be expunged. These include: Vehicle Code Section 42001(b) which includes sections 2800, 2801 and 2803; Penal Code Section 261(d), 286(c), 288, 288a(c), 288.5 and 289(j). Also, if you served time in a state prison the conviction cannot be expunged.
  • Does it matter if I pled guilty or no contest?
    • No, you conviction can be expunged regardless.
  • What happens after my record is expunged?
    • The court will set aside the conviction and dismiss your case.
  • Can employers consider a conviction that has been expunged?
    • In most cases, it is illegal for an employer to ask for information relating to an arrest or detention that did not result in a conviction.
  • Do I qualify to have my conviction expunged?
    • You probably qualify if you have successfully complete probation, have not beenconvicted of the above offenses, and did not serve time in a state prison.
  • Do I qualify to have my felony reduced to a misdemeanor?
    • If your felony conviction qualifies as a wobbler and you were placed on probation, you may be able to get your felony reduced to a misdemeanor.
  • Does expungement restore my gun rights?

    • California's Penal Code, section 1203.4 authorizes the process for expungement.
